across the board whether it's an energy space, environmental space, ect.. it's our job as attorneys general to participate in that transaction is preserved. that's why we filed a lawsuit. we'll see where it heads. it's less about the tax breaks for those corporations. it's more about what responsibility and opportunity has been vested in the state by the affordable care act in preserving that as a stake holder. >> i'm lee parsely with outside lawyer protection for lawsuit reform. in texas, there's a number of statutes that allow attorney general to have multiple violations. for a company that has inadvertently vollied the statute multiple times, those penalties can be substantial. at least philosophically, we've become concerned with that. do y'all have similar statutes in your state? is that an issue that we ought to have on the radar for those of us who are supporting the business community and their concerns about litigation? >> i can take that. that's not an issue to my knowledge. i think it could be -- you got a great attorney general in texas, in my opinion, greg's fantastic.

procurement plan to meet the requirements of the california renewable energy resources act. >> thank you. barbara hill, assistant general manager for power. i am here today to discuss with you the way we are proposing to comply with the california renewable energy resources act. it's more commonly referred to as the rpf legislation. the act requires the puc to meet 100% of our retail sales with hetch hetchy and rps [speaker not understood] generation. what we're proposing to do is rely on our existing processes where possible and appropriate to incorporate compliance into our budgeting and financial planning process. in most years, in 83% of all years, business as usual, no extra action is necessary on the city's part to comply with this legislation. we would need to buy any additional rps supplies, 83% of the time. what i'm here today for is to get input and direction from you on our proposal to give our general manager the authority to procure rps supplies to meet any unexpected requirements when they do occur, typically in dry years or in the event of an unexpected generator outage. a

about its potential impact on everything from economic growth to energy prices. that and more tonight on "n.b.r."! as we go on the air tonight, hurricane sandy is ready to make landfall in the u.s., already it's an historic storm, with historic preparations. stock markets closed. and coast lines evacuated with tens of millions of people sitting in the forecast path of the massive storm. sandy is a huge storm expected to come ashore in southern new jersey. but the hurricane force winds have been battering the eastern seaboard for hours. those winds extend out 175 miles from the center of the storm. those winds are pushing the atlantic ocean up and over many coast-lines. from rhode island, south to the jersey shore. coastal flooding is a significant risk thanks to the storm surge, potentially reaching 11 feet in new york harbor. battery park on the tip of manhattan is under a mandatory evacuation, as waves already have topped the sea wall. low lying areas are at substantial risk of flood waters, including the wall street area, especially if the worst of the surge hits during high tide toni

hour. that expectation will flow. here it is. can you believe the energy of this super storm? eastern portions of it, of course, the hurricane, tropical elements, 9" of rain in delaware. western portions, more of a nor'easter, 9" of snow at least in west virginia and expecting potentially another foot. there's the rain and the snow that is still happening. here is the movement. right now you can see tuesday morning, the center of low pressu pressure. by tonight we're going to see it move and be in only western new york. by tomorrow, it looks from western pennsylvania just -- you can see just west of new york around toronto. so very slow to move. so even by wednesday and into thursday, new york and washington have 25 and 35-mile-per-hour wind gusts. so still a potent storm. the difficulty with this destruction, trying to clean up. this hurricane did not come in and go with certainly not a one-day quick hitter. we'll be doling with it thursday and even into friday. from sandy hook to islip, certainly not the picture anymore. still 50s and 60s today dropping 10 to 15 miles per hour the n

hurricane. all of this, what are you hearing? >> from the energy department. crude oil prices getting a pop right now. and back off near $86 a barrel and while gasoline prices which rose yesterday in anticipation of those refinery closures, they're sort of flat, going back down in today's session. and the energy department saying that u.s. gasoline supplies, along the u.s. east coast, may sink, charles, to their lowest levels since at least 1990's and those refineries if they can't curb production, some of them shut production altogether and also, charles out, important for traders to keep in mind, energy department saying they're delaying the weekly inventory report and remember, that's usually a market moving event like things for oil and gasoline on wednesday morning and they're saying it could be published nurse, but that day still depending on the storm damage and charles, at this point, assessing the damage and six refineries were closed along the east coast, and that was about two-thirds of overall production, so, we're still assessing the damage and still trying to see

with five-hour energy drink or something. he was very fired up. a lot rougher than the presidential debate. they were going at each other like ronnie and sammy after a third round of calm cause zees -- sorry, i was flipping between "jersey shore" and that. seemed to me that joe biden spent 80% of the debate trying not to curse. he actually said the word malarkey at one point. before tonight, we haven't seen paul ryan talk much. he's a very serious guy. paul ryan seems like the guy you see at the bank who really hates standing in line, like, so much, you're afraid he might do something. , significant power outage. about 40,000 customers without power. pico energy is our provider. they do an excellent job under these circumstances, getting people back online. about 400,000 in the region, and so, again, that's a significant number, but i am quite confident that they will chop that number down over the course of the next few days. our primary concerns are about flooding, the heavy winds, continued rain, and treacherous conditions for people. obviously we've been encouraging our citizens to stay in at home, stay off the streets, stay out of your car, and this is not the kind of weather you want to be out in. the city was closed on monday, will be closed on tuesday. schools canceled. colleges and university, many of them not having classes as well. mass transit system is shut down. and certainly won't be operational for the bulk of the day on tuesday. but all in all, philadelphians are rallying around each other. we've not experienced any significant incidents. we have had some structural challenges and at least one fire that i'm aware of. it should soon be under control.

traders are here trading today but these energy markets are electronic trading only with nymex trading floor in new york closed for the day and if you look at crude oil, they are moving in the opposite direction of each other and the opposite direction they were trading yesterday in lieu of the refinery closures for the storm. gasoline down 1/2%, crude oil prices getting a boost near $86 a barrel. we are still trying to digest the actual effect of this storm on the refinery's. we haven't gotten a lot of word from companies that have been affected but the energy department has released this beta saying gasoline stockpiles may sink to the lowest levels since 1990 as a result of sandy. inventories down 16% from a year ago. weekly inventory reports delayed till thursday so bottom line a lot of traders say when markets reopen a lot of the focus is going to look at the supply side of the equation when it comes to the energy markets and stocks like philip and newstar, companies that shed down refineries along the east coast. those are stocks that will be on everybody's radar for the stock exc
